TERMS AND CONDITIONS

Welcome to Nexus Mas! These Terms and Conditions ("Terms") govern your participation as a masquerader in our carnival band. By registering with Nexus Mas and purchasing a costume package, you agree to be bound by these Terms. Please read them carefully.

1. DEFINITIONS

"Band" or "Nexus Mas" refers to Nexus Mas carnival band, its organizers, representatives, and authorized personnel.
"Masquerader" or "You" refers to any individual who registers and purchases a costume package from Nexus Mas.
"Costume Package" refers to the complete costume ensemble including all components as specified for the selected section.
"Carnival Season" refers to the Saint Lucia Carnival period in 2026, including all official events and road march activities.

2. REGISTRATION AND PAYMENT

2.1 Registration

Registration is completed through our official channels only. All information provided must be accurate and complete. You are responsible for maintaining the confidentiality of your registration details.

2.2 Payment Terms

All prices are quoted in the applicable currency and are subject to the payment structure established at the time of registration.
Payment plans, if offered, must be adhered to strictly. Late payments may result in additional fees or cancellation of registration.
Full payment must be received by the specified deadline. Failure to complete payment may result in forfeiture of your costume package.
All payments are processed securely. Processing fees, if applicable, are non-refundable.

2.3 Price Changes

Prices are locked at the time of registration. Nexus Mas reserves the right to adjust prices for future registrations, but registered masqueraders will not be affected by subsequent price changes.

3. COSTUME PACKAGES

3.1 Package Contents

Each costume package includes the components specified for your selected section. Package details, including inclusions and amenities, are subject to the tier level selected at registration.

3.2 Sizing and Measurements

You are responsible for providing accurate measurements by the specified deadline.
Size changes may be accommodated subject to availability and timing constraints. Additional fees may apply.
Minor alterations are the responsibility of the masquerader. We make every effort to ensure proper fit, but variations in costume construction may occur.

3.3 Design Changes

Nexus Mas reserves the right to make modifications to costume designs, materials, or components as necessary for production or logistics. Every effort will be made to maintain the overall aesthetic and quality of the costume.

3.4 Costume Distribution

Costume collection details will be communicated in advance of Carnival.
Costumes must be collected during designated distribution times. You must present valid identification and proof of payment.
Authorized representatives may collect costumes on your behalf with written authorization and valid identification.

4. CANCELLATIONS AND REFUNDS

4.1 Cancellation by Masquerader

All cancellations must be submitted in writing to the official Nexus Mas contact.
Cancellation more than 90 days before Carnival: 75% refund of payments made (less processing fees).
Cancellation 60-90 days before Carnival: 50% refund of payments made (less processing fees).
Cancellation less than 60 days before Carnival: No refund available.
Refund timelines: Refunds will be processed within 30 business days of cancellation approval.

4.2 Costume Transfers

You may transfer your registration to another individual subject to approval by Nexus Mas. A transfer fee may apply. All outstanding payments must be settled before transfer completion.

4.3 Cancellation by Nexus Mas

In the unlikely event that Nexus Mas must cancel operations for Carnival Season 2026, full refunds will be issued. Nexus Mas is not responsible for any additional costs incurred by masqueraders (travel, accommodation, etc.).

5. CONDUCT AND PARTICIPATION

5.1 Code of Conduct

All masqueraders must conduct themselves in a respectful and appropriate manner at all times.
Harassment, discrimination, violence, or illegal activities of any kind will not be tolerated.
Intoxication or disorderly conduct that endangers yourself or others may result in removal from the band without refund.
You must comply with all instructions from Nexus Mas officials and security personnel.

5.2 Age Requirements

All masqueraders must be 18 years or older. Valid identification may be required. No exceptions will be made for minors.

5.3 Costume Care

You are responsible for your costume from the time of collection. Lost, damaged, or stolen costume components cannot be replaced. Please take appropriate care and security measures.

6. LIABILITY AND INSURANCE

6.1 Assumption of Risk

Participation in Carnival activities involves inherent risks. By participating, you acknowledge and voluntarily assume all risks associated with Carnival activities, including but not limited to: physical injury, property damage, exposure to weather conditions, crowds, and other hazards.

6.2 Limitation of Liability

To the fullest extent permitted by law, Nexus Mas, its organizers, officers, employees, agents, vendors, and representatives shall not be liable for any injury, loss, damage, accident, delay, or expense arising from your participation in Carnival activities. This includes but is not limited to: personal injury or death, loss or damage to personal property, costume defects or malfunctions, actions of other masqueraders or third parties, and force majeure events.

6.3 Insurance

Nexus Mas maintains appropriate insurance coverage for its operations. However, you are strongly encouraged to obtain your own personal insurance coverage for travel, health, and personal property.

6.4 Indemnification

You agree to indemnify and hold harmless Nexus Mas from any claims, damages, losses, or expenses (including legal fees) arising from your participation in Carnival activities or any violation of these Terms.

7. PHOTOGRAPHY AND MEDIA

7.1 Media Consent

By participating in Nexus Mas, you grant permission for photographs, videos, and other media featuring you to be taken and used for promotional, marketing, and documentary purposes by Nexus Mas and its authorized representatives.

7.2 Media Usage

Nexus Mas may use such media on its website, social media platforms, promotional materials, and other marketing channels without compensation to you. You waive any rights to review or approve the finished product or any claims arising from the use of such media.

7.3 Personal Photography

You are welcome to take personal photos and videos during Carnival activities for personal use. If you wish to use your costume for commercial purposes or professional photoshoots, you must obtain prior written permission from Nexus Mas.

8. INTELLECTUAL PROPERTY

All costume designs, concepts, branding, and creative works associated with Nexus Mas are the intellectual property of Nexus Mas. Unauthorized reproduction, duplication, or commercial use of any Nexus Mas designs or materials is strictly prohibited.

9. FORCE MAJEURE

Nexus Mas shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to: natural disasters, severe weather, acts of government, civil unrest, strikes, epidemics, pandemics, or any other force majeure events. In such circumstances, Nexus Mas will make reasonable efforts to fulfill its obligations or provide appropriate alternatives. Refunds in force majeure situations will be at the sole discretion of Nexus Mas.

10. COMMUNICATION

10.1 Official Channels

All official communications will be sent via email and/or posted on our official social media channels. It is your responsibility to monitor these channels regularly and ensure your contact information is current.

10.2 Inquiries

For questions or concerns, please contact Nexus Mas through our official contact channels. Response times may vary depending on the volume of inquiries, particularly as Carnival approaches.

11. AMENDMENTS

Nexus Mas reserves the right to modify these Terms at any time. Material changes will be communicated through our official channels. Continued participation after changes are posted constitutes acceptance of the revised Terms.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Saint Lucia. Any disputes arising from these Terms or your participation in Nexus Mas shall be subject to the exclusive jurisdiction of the courts of Saint Lucia.

13. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Nexus Mas regarding your participation in Carnival 2026 and supersede any prior agreements or understandings.

ACKNOWLEDGMENT OF TERMS

By completing your registration and payment for Nexus Mas, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
